What is maternity leave?

Maternity Leave is applicable for female employees for maternity leave of 26 weeks in accordance with the provisions of Maternity Benefit Act, 1961. This is limited to first two deliveries only. This leave is admissible for defined weeks including intervening holidays & weekly offs. Maternity Leave may also be granted, in case of miscarriage on production of a medical certificate for a period not exceeding six weeks immediately following the day of her miscarriage.

Government of India has approved six months fully paid maternity leave to all the working women. This is benefitting around 2 million women. This six month paid maternity leave is applicable for the first two children.

Examples of countries with more generous maternity or parental leave policies than India

India has pretty good maternity leave, especially if you compare it to other countries with a similar GDP/capita, but it’s not close to being the most generous country.

Here’s a few examples of countries with more generous parental leave policies than India:

Sweden has 68 weeks maternity leave, including 18 weeks for the father. Norway has 56 weeks or 46 weeks maternity leave with 10 weeks reserved for each parent and the rest divisible as the couple wishes. Germany has 52 weeks maternity leave. As per my understanding, there are approximately 50 countries (which are are wealthier than India) in the world with a parental leave policy that is at least as generous as the Indian one.

Maternity pay

For maternity pay, Indian government is likely to pay half of extended maternity leave benefit. As per the proposal, the government will pay the salary for 7 weeks of extended leave under maternity pay benefits offered by companies. This amount will be reimbursed to employers who have engaged women workers with a wage ceiling up to Rs 15,000 and provide 26 weeks of maternity pay.

Maternity pay in Sweden has 68 weeks, paid at 80% your normal salary, including 18 weeks for the father. Maternity pay in Norway has 56 weeks paid at 80%, or 46 weeks at 100% your normal salary with 10 weeks reserved for each parent and the rest divisible as the couple wishes. Maternity pay in Germany has 52 weeks paid at 67% normal salary.
